EVENT TERMS AND CONDITIONS

By registering for a Raintank, Inc. (DBA Grafana Labs) (“Grafana Labs”) event (the “Event”), and in consideration of the benefit of participating in the Event, you agree to the following:

CODE OF CONDUCT
All attendees at any event hosted by Grafana Labs are required to comply with the event code of conduct set forth here: https://grafana.com/about/events/events-code-of-conduct/.

PHOTOGRAPHY & VIDEOGRAPHY
You may be photographed, videotaped, or otherwise recorded while attending the Event, and you consent to the same. You agree and accept that Grafana Labs may use your name, likeness, and any other media relating to the event involving you in any way Grafana Labs sees fit. To the extent that you participate in a filmed interview, you agree that your name, image, voice, likeness, and statements will be filmed, photographed, or otherwise recorded, and further you agree to grant Grafana Labs a perpetual, worldwide right and license to use, copyright, distribute, reproduce and publicly display such recording, in whole or in part, including, but not limited to, in connection with promotional materials and via the internet. You agree that you shall have no right, title or interest in any recordings obtained by Grafana Labs at the Event and shall not be entitled to derive any benefits or receive any compensation in relation to the same.

SOLICITING DURING THE CONFERENCE
Suitcasing, outboarding guerilla marketing or similar marketing tactics are prohibited at the Event. Grafana Labs reserves the right in its sole discretion to remove any individual from the Event who is reported to be soliciting during the conference and who is not an official event conference sponsor or exhibitor.

ADMITTANCE
In its sole discretion, Grafana Labs reserves the right to refuse admittance to any individual or expel any attendee from the Event. Grafana Labs also reserves the right to deny admittance to the Event to anyone who has registered under false pretenses (e.g. companies or attendee names that do not exist, individuals who are under-aged, etc.) and to retain any Event registration fees previously submitted for such registrations. In the event of expulsion from the Event, Grafana may determine whether or not to provide a refund of any Event fees in its sole, reasonable discretion.

CANCELLATION
Grafana Labs may cancel the Event or change its content at any time and may deny, limit, or cancel a registration for the Event (including a confirmed registration) at any time. Grafana Labs is not responsible for any damages, direct or indirect, resulting from such cancellation. If Grafana Labs cancels the Event or your registration, so long as you are in compliance with this Agreement and any refund policy listed on the registration page for the Event, Grafana Labs will issue you a full refund of any Event registration fee that you have paid in accordance with that refund policy.

ASSUMPTION OF RISK, COVID-19 SAFETY
You acknowledge and agree that your attendance and participation in the Event is voluntary. You agree to assume the risks, known and unknown, in any way associated with attending and participating in the Event to the fullest extent permitted under applicable law. You accept full responsibility for any liability, injury, loss, damage or death in any way connected with your participation in the Event. You additionally acknowledge and agree that: (i) there are inherent risks with attending in-person events and that Grafana Labs cannot guarantee that participants will not be infected with COVID-19; and (ii) they hereby assume all risks related to COVID-19.

LIMITATIONS OF LIABILITY
IN NO EVENT WILL (A) GRAFANA LABS, ITS AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AGENTS, SUCCESSORS OR ASSIGNS (THE “GRAFANA PARTIES”) BE LIABLE FOR ANY LOSS OF DATA, LOSS OF PROFITS, LOSS OF OPPORTUNITY, COST OF COVER OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL, INDIRECT, PUNITIVE, EXEMPLARY OR RELIANCE DAMAGES OR (B) THE AGGREGATE LIABILITY OF THE GRAFANA PARTIES FOR ALL OTHER DAMAGES IN CONNECTION WITH THE EVENT EXCEED $100 USD.

MISCELLANEOUS
This Agreement may only be amended or assigned by a written instrument executed by an authorized agent of Grafana Labs and yourself. You expressly agree that this Agreement is intended to be as broad and inclusive as is permitted by law, and if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. No oral, written or implied representations, statements or inducements apart from this Agreement have been made to you.The construction and meaning of the terms and provisions of this agreement will be interpreted in accordance with the laws of the State of New York.
